U.S. district judge Vaughn R. Walker will issue a ruling this morning on whether to stay a decision in the Proposition 8 federal case pending appeal, according to a late Wednesday e-mail from the court. The ruling will be issued between 9 a.m. and noon Pacific time. If Walker rules against the stay, the state of California could presumably allow same-sex couples to wed once again. Such unions have been illegal since voters in the state passed Prop. 8 in November 2008.

Florida attorney general Bill McCollum tried to explain his remarks that gay people should be barred from serving as foster parents, saying he would await an appellate court ruling before launching any push to change the law. McCollum, a Republican gubernatorial candidate, was quoted earlier this week by the Florida Baptist Witness as saying he supported a change in state law to bar gay people from serving as foster parents. Florida law currently prohibits adoption by gay people but allows them to foster children. The adoption ban awaits an appeals court decision

Lamar Smith of Texas, Michele Bachmann of Minnesota, Steve King of Iowa, and John Fleming of Louisiana spoke with reporters Tuesday about the Prop. 8 ruling.

Officials in southern California's Imperial County, where 70% of voters approved Proposition 8 in 2008, have appealed Judge Vaughn R. Walker's decision in Perry v. Schwarzenegger to the U.S. Court of Appeals for the Ninth Circuit. The legal team representing two gay couples who sued the state had argued in court filings that Imperial County does not have standing to sue. "Imperial County fails to satisfy any of the requirements for intervention as of right," the attorneys wrote. "Its motion is indisputably untimely, and it lacks any cognizable interest in this case—much less a significantly protectable one."

Florida attorney general Bill McCollum, who paid disgraced “ex-gay” leader George Rekers to testify in support of the state’s law that bans adoptions by gay people, says that he also thinks gay people should be prohibited from serving as foster parents. McCollum, a Republican candidate for governor, has defended the harsh adoption law, which is the subject of a pending appeals court decision. Recently, he told Florida Baptist News that outlawing adoptions by gay people does not go far enough.
